Public comments sought regarding Hawaii State Department of Education’s (Department) request for fiscal flexibility under ESEA

The Department is seeking public comments on its waiver request to extend the period of availability for three of its federal programs under the Elementary and Secondary Education Act (ESEA).

Pursuant to section 8401 of the Elementary and Secondary Education Act of 1965 (ESEA), the Department is requesting a waiver for the period of availability of funds in section 421(b) of the General Education Provisions Act (GEPA). Specifically, HIDOE is requesting a 12-month extension of the September 10, 2024 date of the 2022 federal fiscal year funds for the following programs:

  • Title I, Part C of the ESEA (Migrant Education); 
  • Title III, Part A of the ESEA (English Language Acquisition, Language  Enhancement, and Academic Achievement Program for Limited English Proficient Children); and
  • Title IV, Part A of the ESEA (Student Support and Academic Enrichment Grants).
If granted, the waiver will provide the Department with continued flexibility to spend down vital federal funds that will assist the Department’s ability to coordinate innovative approaches to maintain the continuity of learning for all Hawaii public school students.

We appreciate any feedback regarding Hawaii’s waiver request for an extension of the period of availability of funds pursuant to section 421(b) of the General Education Provisions Act (GEPA).
