Parent Rights in Special Education

Parents of children who receive or who may be eligible for special education services have rights under federal/state law.

The Hawaii Department of Education (Department) wants to ensure that all students who need special services are supported, and wants you to know about your rights regarding Special Education. The procedural safeguards explains parent rights under the Individuals with Disabilities Education Improvement Act (IDEA), 34 Code of Federal Regulations (CFR), and the Hawaii Administrative Rules(HAR). 

Procedural Safeguards Notice 

In accordance with 34 CFR §300.504(a) and HAR §8-60-59, schools are required to provide a copy of theProcedural Safeguards Notice to parent(s) only one (1) time a school year, except that a copy must also be givento parent(s) during the following circumstances:

(1) Upon initial referral or parent(s) request for evaluation;

(2) Upon receipt of the first State complaint and upon receipt of the first due process complaint in a school year;
(3) In accordance with discipline procedures in 34 CFR §300.530(h); and
(4) Upon request by a parent(s).

  • Contact your child’s school staff (e.g. special education teacher, principal, etc.) to discuss the issue or concernyou have.
  • Discuss the situation with your school’s District Educational Specialist.
  • Reach out to the Complaints Management Program, Monitoring and Compliance Branch (MACB), for informationand clarification about federal and state special education laws.
  • A more formal approach to help resolve the issue through dispute resolution.
