Since the initial passage of the Elementary and Secondary Education Act (ESEA) in 1965, reauthorized as the Every Student Succeeds Act (ESSA) in 2015, private school students and teachers have been eligible to participate in certain federal education programs. Under ESSA, this includes participation under Sections 1117 and 8501.
To help ensure such equity for private school children, teachers, and other educational personnel, the SEA shall designate an ombudsman to monitor and enforce the requirements of this part pursuant to the ESSA Section 1117(a)(3)(B).
To ensure timely and meaningful consultation, HIDOE shall consult with appropriate private school officials during the design and development of such agency’s programs under this part. Such agency and private school officials shall both have the goal of reaching agreement on how to provide equitable and effective programs for eligible private school children, the results of which agreement shall be transmitted to the ombudsman designated under subsection (a)(3)(B) pursuant to the ESSA Section 1117(b)(1).
To help ensure equitable services are provided to private school children, teachers, and other educational personnel under this section, HIDOE shall direct the ombudsman designated by the agency under Section 1117 to monitor and enforce the requirements of this section. According to the ESSA sections 8501(a)(3)(B) and 8501(b)(1), this section applies to programs under:
- Title I, Part A. Designed to provide all children significant opportunity to receive a fair, equitable, and high quality education, and to close educational achievement gaps.
- Title I, Part C. Support high quality education programs for migratory children and help ensure that migratory children who move among the states are not penalized in any manner by disparities among states in curriculum, graduation requirements, or state academic content and student academic achievement standards.
- Title II, Part A. Provide private school teachers and school leaders with professional development opportunities to support effective instruction.
- Title III, Part A. Services to benefit English Language Learners (ELLs) children and Immigrant Children and Youth (ICY).
- Title IV, Part A and B. Create community learning centers that provide academic enrichment opportunities for children, particularly students who attend high poverty and low-performing schools.
